Supreme Court Hijab Ban: सुप्रीम कोर्ट में आज इस मसले पर कुल 24 याचिकाएं सुनवाई के लिए लगी थीं। सभी में 15 मार्च को आए कर्नाटक हाई कोर्ट के फैसले को चुनौती दी गई है।
शैक्षणिक संस्थानों में हिजाब पर पाबंदी के मामले में सुप्रीम कोर्ट ने कर्नाटक सरकार को नोटिस जारी किया है। आज याचिकाकर्ताओं की ओर से सुनवाई टालने के आग्रह पर सुप्रीम कोर्ट ने फटकार भी लगाई है। कोर्ट ने कहा, पहले आप ही जल्द सुनवाई की मांग कर रहे थे। अब सुनवाई टालने की मांग कर रहे हैं। हम इस तरह से याचिकाकर्ताओं को अपनी पसंद की बेंच चुनने की इजाज़त नहीं देंगे।
कर्नाटक HC के फैसले को SC में चुनौती
याचिकाकर्ताओं ने कर्नाटक हाई कोर्ट के फैसले के खिलाफ सुप्रीम कोर्ट का रुख किया था। 15 मार्च को कर्नाटक हाईकोर्ट ने फैसला दिया था कि महिलाओं का हिजाब पहनना इस्लाम का अनिवार्य हिस्सा नहीं है और स्कूल-कॉलेज में यूनिफॉर्म के पालन का राज्य का आदेश सही है। इसके अलावा कुछ याचिकाकर्ताओं ने हिजाब पहनने को मुस्लिम लड़कियों का अधिकार बताते हुए सीधे सुप्रीम कोर्ट का रुख किया था।
कोर्ट की याचिकाकर्ताओं को फटकार
आज सुनवाई के दौरान कुछ याचिकाकर्ताओं की ओर से पेश वकील ने मामले की सुनवाई को टालने का आग्रह किया। जस्टिस हेमंत गुप्ता और जस्टिस सुधांशु धूलिया की बेंच ने कहा कि पहले याचिकाकर्ता जल्दी सुनवाई की मांग कर रहे थे और अब सुनवाई टालने की मांग की जा रही है। हम इस तरह की फोरम शॉपिंग (अपनी पसंद की बेंच चुनने) की इजाज़त नहीं दे सकते।

कोर्ट ने नोटिस जारी किया
सुनवाई के दौरान सरकार की ओर से सॉलिसिटर जनरल तुषार मेहता पेश हुए। उन्होंने भी सुनवाई टालने के आग्रह पर सवाल उठाया। एसजी मेहता ने कहा कि इससे पहले कम से कम 6 बार याचिकाकर्ता सुनवाई टालने के आग्रह कर चुके हैं। इस पर याचिकाकर्ता के वकील ने कहा कि उस वक्त परीक्षाएं होने वाली थीं। लिहाजा याचिकाकर्ता जल्द सुनवाई चाहते थे।

सुनवाई के दौरान वकील ने ये भी कहा कि इस मामले में याचिकाकर्ता देश के अलग-अलग हिस्सों से हैं। कुछ कर्नाटक से भी है। इस पर सुप्रीम कोर्ट ने कहा कि सिर्फ ढाई घंटे में कर्नाटक से दिल्ली आया जा सकता है। बहरहाल SG तुषार मेहता ने कोर्ट से आग्रह किया कि इस मामले में नोटिस जारी कर दिया जाए ताकि मामले का जल्द निपटारा हो सके। इस पर सुप्रीम कोर्ट ने नोटिस जारी कर दिया। सोमवार 5 सितंबर को अगली सुनवाई होगी।
