NEW DELHI: केंद्रीय गृह मंत्रालय ने बुधवार को राज्य सरकारों और पुलिस अधिकारियों के लिए सूचना प्रौद्योगिकी से जुड़े नये दिशा निर्देश जारी किये हैं। गृह मंत्रालय राज्य सरकारों और पुलिस प्रमुखों से अपील की है कि वह सूचना प्रौद्योगिकी (आईटी) अधिनियम की निष्क्रिय धारा 66 ए के तहत मामले दर्ज नहीं करें और जो मामले पहले से दर्ज हैं उन्हें भी तुरंत वापिस लिया जाए।
हाल ही में सुप्रीम कोर्ट ने अपने एक बयान में कहा था-कानून को खत्म किए जाने के बाद दर्ज किए गए मामलों के हैरान कर देने वाले हैं..राज्य आज भी इस निरस्त धारा का इस्तेमाल कर रहे हैं जो गलत हैं। साल 2015 में शीर्ष अदालत ने सूचना प्रौद्योगिकी (आईटी) अधिनियम की धारा 66 ए को रद्द कर दिया था। कोर्ट का कहना था-यह ने भारतीय नागरिकों के भाषण और अभिव्यक्ति की स्वतंत्रता के अधिकार को बाधित करती है। सिर्फ पुलिस के विवेक पर सोशल मीडिया भड़काऊ या अपमानजनक पोस्ट करने पर लोगों को गिरफ्तार करने के लिए कई मामलों में कानून का इस्तेमाल किया गया।
बता दें कि एनजीओ पीपुल्स यूनियन फॉर सिविल लिबर्टीज ने अदालत में याचिका दर्ज की थी जिसमें 66ए कानून निरस्त होने के बाद 745 मामले दर्ज किये जाने की जानकारी दी थी। जिसमें आरोपियों पर आईटी अधिनियम की धारा 66 ए के तहत मुकदमा चलाया जा रहा है। 5 जुलाई को इस मामले पर सुनवाई करते हुए कोर्ट ने कहा था-ये “क्या चल रहा है? यह भयानक और हैरान कर देने वाला है..कानून निरस्त होने के बाद मुकदमा कैसे दायर हो रहे हैं
