Karnataka Bangalore News Updates: कर्नाटक उच्च न्यायालय ने मंगलवार को हिजाब पर प्रतिबंध को बरकरार रखा है, और राज्य में शैक्षणिक संस्थानों में स्कार्फ पर प्रतिबंध को चुनौती देने वाली विभिन्न याचिकाओं को खारिज कर दिया है। हाई कोर्ट ने कहा कि हिजाब पहनना इस्लाम की अनिवार्य धार्मिक प्रथा नहीं है।
इससे पहले बीते महीने 10 फरवरी को अपने अंतरिम आदेश में, उच्च न्यायालय ने छात्रों को अंतिम आदेश दिए जाने तक कक्षा के भीतर भगवा शॉल, (भगवा) स्कार्फ, हिजाब, धार्मिक झंडे या इस तरह के अन्य पहनने से रोक दिया था। अब आज मंगलवार को हाईकोर्ट के इस आदेश के बावजूद मामला सुप्रीम कोर्ट तक जाने की उम्मीद है। कर्नाटक उच्च न्यायालय ने आज मंगलवार को फैसला सुनाया कि इस्लाम में हिजाब पहनना अनिवार्य प्रथा नहीं है।
कर्नाटक उच्च न्यायालय ने आज मंगलवार को फैसला सुनाया कि इस्लाम में हिजाब पहनना अनिवार्य प्रथा नहीं है। ग़ौर करने वाली बात है कि उच्च न्यायालय की यह महत्वपूर्ण टिप्पणी दक्षिणी राज्य में बड़े पैमाने पर विवाद के बीच आई है, जो पिछले साल के अंत में शैक्षणिक संस्थानों में हिजाब पहनने को लेकर शुरू हुई थी। राज्य सरकार के प्रतिबंध को बरकरार रखते हुए, अदालत ने मंगलवार को कहा कि “स्कूल यूनिफॉर्म का निर्धारण एक उचित प्रतिबंध है।” अदालत ने कहा, ” राज्य सरकार के पास सरकारी आदेश जारी करने की शक्ति है।”
कोर्ट ने कहा कि कर्नाटक सरकार का पांच फरवरी का आदेश असंवैधानिक नहीं है।
अदालत हिजाब विवाद पर तीन प्रमुख सवालों का जवाब दे रही थी: “1) क्या हिजाब पहनना इस्लामी आस्था में अनुच्छेद 25 के तहत संरक्षित एक आवश्यक धार्मिक प्रथा है? 2. क्या स्कूल की वर्दी का आदेश अधिकारों का उल्लंघन है। 3. क्या 5 फरवरी को सरकारी आदेश बिना सोचे-समझे और स्पष्ट रूप से मनमाना जारी किया गया था?”
